    Did anyone receive card mailed e-mail/status update? I saw one member receive that.

    Today I received an email "Approval notice sent."

    Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

    Current Status: Approval notice sent.

    On August 12, 2008, we mailed you a notice that we have approved this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS. Please follow any instructions on the notice. If you move before you receive the notice, call customer service.


    I was expecting my cards for the last 2 days. But nothing happend, hope I will receive my cards by this Friday.

    All who are still waiting for FP, a suggestion based on my personal experience. If you are calling TSC, then it will not make any difference as you will not receive FP notice even after calling and waiting for months. I would suggest take Infopass and get the FP scheduled. For NSC, sometimes if you get nice IO they may schedule you right away and tell you the date of FP on the phone itself. This info is all based on my past experiences of reading various threads and calling TSC. So I am not sure what the trend is right now.

    Everybody has been waiting for his/her green card and congratulations to all those who has got their GC. On the other hand it is really unfair and to some extent unethical on the part of USICS not follow a fair system.
    There are several people in 2004, 2005 who have been paitently waiting for their turn only to see that people behind them getting approved.
    Several of us have writtent to Ombudsman, Director but of no avail.
    Not sure what else can be done? Any Idea? Do we have any liaison with AILA who can take up this matter.

    Not only this situation , CIS is not fair in many situations.

    1.Issuing Stamping to liars(Who says they don't have intention to settle in US when they go for F1/H1 stamping) and rejecting stamping to honest people(whom they doubt that they may settle permanently in US) at consulate.
    2.Making Eb2/Eb3 current(July 2007) for the purpose of fees.
    3.Substitute labors
    4.Giving visa number to spouse(for example not even passed 10th standard) of EB2 applicant , instead of EB3 qualified candidate(for example Computer Science Graduate from reputed universities)
    5.Not following PD

    Sorry for my French guys...I generally dont like to use bad words, but this Charles Oppenheim boils my blood...

    Look at all his previous statements...I dont know under what kind of influence he makes his statements...

    He has BSed us in the past (look at his prior statement that he made in VEGAS) ....

    Now he is BSing us again....

    And we take his words seriously and start another set of arguments....

    God bless every one; I need to calm down now. If possible please ignore this Oppehemi guy; he is just another joker.

    This is what my lawyer mailed us today (I have always had good service from him):
    In my very initial thoughts, on July 2 and July 3, I believed the lawsuit had no chance; but in following this more closely and doing my own research, I think increasingly that the lawsuit has merit. USCIS and DOS appear to have violated various of its internal rules and arguably actual statutes and regulations in handling all this.


    Not that I am holding my breath, but just wanted pass it on....

    Even if we have five people agree to file this class action lets do it .....
    Once we have this law suit filled I'm sure will have the visiblity and whole band wagon will behind us.

    1, Let choose an attorney who understands our pain wants to fight for our cause. if its Rajiv Khanna so be it.

    2, Whatever the inital attorney consultion let split the consultation fee between five of us.

    3, Once we have a stream lined class action in place will gather more people.

    I absolutely agree what you said this will atleast help us to predict where we are with the processing ..If this whole thing is going to take 22 years tell us now..so we won't F****** throw away our life waiting for it.


    let us mass file FOIA with USCIS every month. Let us overburden them iwth information that we want to get. Officially they can act on our request or deny it in 20 office days. Then we should file a lawsuit based on FOIA if USCIS does not provide information in 20 business days.

    Same here..But I am little lucky.My PD is May 2003.
    I sent the documents by June 8th,

    On June 25th I wrote them a sentimental email saying that I have not been to my home country in the last 4 years and would love to see my parents in ailing(Sorry Dad!!) december atleast. I mentioned them that getting h1B stamping is really a pain and would like to have EAD/AP by then. So its better to get in the queue before the July 1st rush

    Luckily they sent my package on June 26th. Hope it had reached the USCIS on time and mine is accepted.

    Yeah, I know my life sucks. I have a priority date of Jan 2003. Got filed under EB3 even though did MS here... I begged and pleaded that they atleast send it on Jan 28th. For god's sake, I was qualified all the way since June 1st. I gave all the documents necessary by June 6th itself. Well, but they had to file on 29th.

    You have still not answered my question - where did you get the idea that I am here self imposing high standards? You have talked about everything else but that. So you have decided to take refuge by not answering the main reason why I said you are making accusations.

    And just to prove that you are not off the mark, you are confusing everyone else who is reading the posts, between being on the right side morally and having a high standard in general! Again, get this into your head before you start typing more nonsense.

    I totally get that people like you need to feel like everyone is more or equally corrupt than themselves, and that you try very hard to push down someone's throat that they are also as flawed as you are.     Hello Guys,

    I filed on july 7th and still waiting.
    My case little different, my 485 pending at Nebraska and I mailed EAD renewal at Texas (because I live in PA, per instructions in form).

    Do you think my EAD will get stuck because of this? I hope I did right thing.

    Is any one similar situation

    I am in exact same situation too. The notice date for EAD renewal is July 7th, 2008. I-485 pending at NSC and EAD applied at TSC. Still waiting. I am current as my PD is EB-2 India 9/2004.

    You wouldn't have felt that way if you were EB-3 India sittinig for last 8 years, reading Visa Bulletins every months, just to find it still in Oct'2001...And if you ask USCIS what's going on they ask you 5K.
    Funny how some people call this country cap 'discrimination.' If this is discrimination, then everybody is being discriminated, as the country cap applies to all countries, not just India and China. Since everybody is 'discriminated,' then it is not discrimination anymore.:)

    I got my receipts by mail on monday and checks cashed last friday. But my wifes did not clear yet. any one in similar situation please post.

    My one set of checks cleared last friday & other set yet to be cleared. That might be for me or wife, no idea. So I'm waiting.
    How are you so sure that your case checks were cashed & not your wife's just curious.

    I've no problems you or anybody else challenging me--we're all (mostly) scientists/engineers here, so making assumptions based on observations, and challenging them, should be the first step toward creating a hypothesis (http://en.wikipedia.org/wiki/Scientific_method). But science seeks evidence for those assumptions. Staying clear of traps like fallacies (http://en.wikipedia.org/wiki/Fallacy) should help.

    Ok, i am not challenging you or your interpretations. I am looking into all options.

    I would advise not to go for your landing. At this point you need to make a decision whether you want to pursue canadian GC or US GC. If you have applied for 485 then it best that you not do the canadian landing. You may have issues when you come back to US. They may ask you why you went to canada and you cannot lie and have to tell them the truth. This may raise questions on your intent to pursue US GC. It all depends on your luck as to who you get the IO. I have heard of a case where a person got RFE on 485 after completing the landing.

    If you still want to do the landing then you should be prepared for RFE or NOID on your 485.

    Thanks dingudi. If you know of a solid case where someone was RFE'd because of landing while on 485, then it looks like I might seriously consider abandoning it as well.

    One last question: Let's hypothetically say that I do decide to land and somehow manage to get back into the US without any issues using my AP. However, every subsequent time I leave the U.S. and return, I run the risk of getting "caught" at the POE with regards to the 485/Canadian residency conflict. Am I correct in this assessment?
